These Terms apply to all users of the Platform, including artists, clients, and visitors. By creating an account, submitting information through our landing page, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Totally Flawless is an on-demand hair and makeup platform that connects clients with vetted professional artists. Our Platform facilitates:

• Artist discovery and portfolio browsing
• Booking and scheduling of beauty services
• Communication between artists and clients
• Payment processing for services
• Review and rating systems

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

3.2 Artist Accounts

Artists must provide portfolio photos, professional credentials, and service information. By creating an artist account, you represent that:

• You are a qualified professional in hair and/or makeup artistry
• All portfolio photos are your original work or you have permission to use them
• Your credentials and qualifications are accurate and verifiable
• You will maintain professional standards and comply with applicable licensing requirements

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem necessary to protect the Platform and its users.

4. User Conduct and Responsibilities

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Impersonate any person or entity or misrepresent your identity
• Upload, post, or transmit any content that is harmful, offensive, or violates others' rights
• Interfere with or disrupt the Platform's operation or security
• Attempt to gain unauthorized access to any part of the Platform
• Use automated systems (bots, scrapers) to access the Platform without permission
• Harass, abuse, or harm other users
• Collect or store personal information about other users without permission
• Use the Platform to compete with or harm Totally Flawless

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of content you upload to the Platform (photos, videos, text, etc.). By uploading content, you grant Totally Flawless a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the Platform for the purpose of providing our services.

You represent and warrant that you own or have the right to use all content you upload and that it does not infringe on any third-party rights.

5.2 Platform Content

All content on the Platform, including text, graphics, logos, software, and design, is owned by Totally Flawless or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6. Bookings and Services

6.1 Service Agreements

When a booking is made through the Platform, a service agreement is formed directly between the artist and client. Totally Flawless acts as a platform facilitator and is not a party to the service agreement.

6.2 Artist Responsibilities

Artists agree to:

• Provide services as described in their profile and booking details
• Arrive on time and prepared for appointments
• Use professional-grade products and maintain hygiene standards
• Comply with all applicable licensing and regulatory requirements
• Maintain appropriate insurance coverage
• Communicate professionally and promptly with clients

6.3 Client Responsibilities

Clients agree to:

• Provide accurate booking information and requirements
• Be available at the scheduled time and location
• Provide a safe and appropriate environment for services
• Communicate any allergies, sensitivities, or special requirements
• Respect the artist's time and professional boundaries

6.4 Cancellations and Refunds

Cancellation and refund policies are determined by the artist and communicated at the time of booking. Totally Flawless may facilitate refunds in accordance with our policies and applicable law, but the ultimate responsibility lies with the artist and client.

7. Payments and Fees

Payments for services are processed through our Platform. We may charge service fees or commissions as disclosed at the time of booking. All fees are non-refundable unless otherwise stated or required by law.

You agree to pay all charges associated with your use of the Platform. We reserve the right to change our pricing at any time, with notice to users.

8. Disclaimers and Limitation of Liability

8.1 Service Disclaimer

Totally Flawless provides a platform for connecting artists and clients. We do not provide beauty services ourselves. We are not responsible for:

• The quality, safety, or outcome of services provided by artists
• Disputes between artists and clients
• Injuries, damages, or losses resulting from services
• The accuracy of artist profiles, portfolios, or credentials

8.2 Platform Availability

The Platform is provided "as is" and "as available." We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

8.3 Limitation of Liability

To the maximum extent permitted by law, Totally Flawless shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

9. Indemnification

You agree to indemnify, defend, and hold harmless Totally Flawless, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or transmit through the Platform
• Services you provide or receive through the Platform

10. Dispute Resolution

If you have a dispute with another user, we encourage you to contact us for assistance. However, Totally Flawless is not obligated to resolve disputes between users.

For disputes with Totally Flawless, you agree to first contact us to attempt to resolve the dispute informally. If we cannot resolve the dispute, you agree to binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in the United States.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
